Section 1: Acceptance of Terms
By accessing or using Marketing Stack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Section 2: Description of Service
Marketing Stack is an AI-powered marketing automation platform that detects brand identity from websites, generates marketing assets (images and videos), and publishes them to social media platforms on automated schedules.
Section 3: Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.
Section 4: Acceptable Use
You agree not to: (a) use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) attempt to gain unauthorized access to the Service or its systems; (c) use the Service to infringe on any intellectual property rights; (d) resell or redistribute the Service without authorization.
Section 5: Generated Content
Content generated by the Service using your brand data belongs to you. However, you are responsible for ensuring that generated content complies with applicable laws and the terms of the social media platforms where it is published. Marketing Stack does not guarantee that AI-generated content will be free from errors or suitable for any particular purpose.
Section 6: Third-Party Integrations
The Service integrates with third-party platforms including social media networks. Your use of these integrations is subject to the respective platforms' terms of service. Marketing Stack is not responsible for the actions or policies of third-party services.
Section 7: Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.
Section 8: Billing, Cancellations, and Refunds
Subscriptions: The Marketing Stack Pro plan is billed monthly at the current rate. The Multi-Brand add-on is a one-time payment.
Free Trial: New users receive a 3-day free trial. During the trial, image pipeline features are available. After the trial expires, an active subscription is required to create or run pipelines.
Cancellation: You may cancel your subscription at any time through the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You will retain access until then.
Refunds: Subscription fees are non-refundable except where required by law. If you believe you were charged in error, contact us at contact@marketingstack.app within 14 days of the charge.
Price Changes: We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect.
Section 9: Intellectual Property
The Service, including its software, design, and documentation, is the intellectual property of Marketing Stack. You may not copy, modify, or reverse-engineer any part of the Service.
Section 10: Limitation of Liability
The Service is provided "as is" without warranties of any kind. Marketing Stack shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Section 11: Termination
We may suspend or terminate your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after termination.
Section 12: Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.
